Reasons

Ms Yates and Ms Williams, representing the landlord, both attended the hearing. The phone numbers for the tenants, the last three digits being 495 and 423 respectively, were each called twice, without any response. As the tenants were served, the hearing proceeded in their absence.
The landlord has applied for rent arrears, compensation and reimbursement of the filing fee following the end of the tenancy. During the hearing, the landlord withdrew their claim for rent arrears, as this claim was dealt with in application 5079813, with a Tribunal order dated 14 January 2025.
During the hearing, the landlord wanted to add two additional compensation claims, for painting and a broken toilet, but these had not been notified to the tenants, in the application or otherwise, and there was insufficient time scheduled to hear additional compensation claims at the hearing. As such, I suggested to the landlord that they could file a separate claim for any additional compensation claims.
The landlord said the tenancy ended on 19 January 2025.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (“RTA”). Cleaning and rubbish removal
The landlord said the tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. The landlord said the tenants had a dog and multiple cats at the property. The landlord provided photographs of the condition of the property at the end of the tenancy. The photographs showed rubbish and belongings left throughout the property at the end of the tenancy, which included towels, toiletries, bags of clothes, baskets, boxes, shoes, sleeping bags, cleaning items, rubbish bins overflowing and many other items.
The photographs provided by the landlord showed dirty floors, dirty kitchen bench and cupboards, wall markings, bathroom that needed cleaning. The landlord said the oven was also dirty, as were the windowsills and skirting boards. The landlord said it took the cleaner two vacuum bags to get up the pet hairs in the carpet and then the carpet needed further steam cleaning and treatment, as there was pet vomit found under the beds and other stains in the carpet throughout the property. Some photographs were also provided of the condition of the carpet, which showed these stains and vomit.
The landlord provided an invoice for rubbish removal and cleaning in the amount of $1,090.38 and a further invoice for carpet cleaning in the amount of $240.00.
Given the evidence provided, I find the tenants did not leave the premises reasonably clean and tidy and did not remove their rubbish. I find the amounts claimed by the landlord for rubbish removal and cleaning, and for carpet cleaning, to be reasonable, given the evidence. Therefore, I award the landlord $1,090.38 for rubbish removal and cleaning and $240.00 for carpet cleaning. Gardening
The landlord said the gardens were also left unkempt and unmaintained at the end of the tenancy. The landlord provided photographs of the garden which showed the lawns were overgrown and weeding was required. The landlord said it took around 4 hours for the garden to be cleaned up and the lawns mowed and waste disposed of, and provided an invoice in the amount of $376.67 for the gardening work. I find this amount to be reasonable, given the evidence of the gardening work required at the end of the tenancy. Therefore, I award the landlord $376.67 for gardening work. Locks
The landlord said the tenant did not return the keys. The landlord said the tenant was given 3 front door keys and 1 garage door remote, which were not returned. The landlord provided an invoice to replace the locks for $339.02, which I find reasonable. Therefore, I award the landlord $339.02 to replace the locks.
The amounts ordered are proved. Filing fee
Because Iron Bridge Property Management Limited As Agent For Trevor & Maxine Roughan has been successful with the claim I must reimburse the filing fee.
