Reasons

The landlord attended the hearing, set down to be conducted via video. There was no appearance by the tenants. They are believed to have relocated overseas. I was satisfied adequate service had completed and I continued with the hearing.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
This was a one year fixed-term tenancy that commenced 18 November 2024. However, the tenants left the tenancy with notice in March 2025. A new tenancy commenced 16 April 2025.

How much is owed for rent and water rates?

The tenancy ended on 15 April 2025. The tenants had already vacated prior for overseas. A new tenancy commenced 16 April 2025, therefore ending tenant rent liability. The landlord provided rent records and water rates invoices which prove the amounts owing at the end of the tenancy are as ordered.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The landlord claims the tenants did not leave all of the premises reasonably clean and tidy, and did not remove all rubbish. It claimed the small lawn and gardens required attention.
In support of these claims the landlord provided invoices and photos. These evidence the need and costs for the tasks as claimed, albeit more a series of small remedial actions as reflected in the cost incurred. The condition of the majority of the premises was reasonable but some areas were missed. The additional costs as claimed are proven and awarded. Break cost
The landlord sought compensation of $747.50, being costs claimed as incurred due to the early release.
Clause 27 of the tenancy agreements states:
This clause correctly reflects the statutory requirements of s 44A RTA.
It appears the tenants were sent an invoice on 13 February 2025. It was not provided to the Tribunal but the landlord confirmed it was a single line item for $747.50. No further itemisation was provided. The date of the invoice appears to predate any incurring of any costs associated with the tenants’ early release. No itemised account of the incurred expenses was provided to the tenants.
I dismiss the claim here as unproven. Filing fee
Because Ray White Remuera Property Management Limited As Agent For Fei Li & Wing Yeung Chan has substantially succeeded with the claim I have reimbursed the filing fee.
