The Bond Centre is to pay the bond of $414.00 (6556829-009) immediately apportioned as follows: Freedom Property Management Limited Wesley Stephen Smith: $235.00 Anna Cooper and Andrew James Cooper: $179.00

Reasons

Both parties attended the hearing by telephone.
The parties had attended mediation where agreement was reached except for the landlord’s claim for painting damaged areas.
The Mediators Order records that the bond had been released in accordance with the agreement except for $414.00 which is the amount in dispute and that has remained with the Bond Centre.
The landlord’s claim is in relation to marks on a door jamb, the walls and doors. Some of those marks have penetrated the paint surface.
The tenant has acknowledged causing damage to two areas, being the wall where an adhesive hook had been removed taking with it a layer of paint, and the angled roof of the laundry where the washing machine and drier had been stacked.
For the laundry damage the tenant submitted that the space was tight, and the damage was caused from the drier knocking against the wall.
For the door jamb damage, the tenant submitted that the damage was caused by the black blind rubbing against the door jamb when used.
The tenant denies patching the wall as shown in one of the photographs.
After consideration of all the evidence I consider that some of the damage is fair wear and tear or in other terms a result of normal, expected everyday use. Some of the damage is beyond fair wear and tear and was caused by these tenants during this tenancy.
The invoice submitted by the landlord amounts to $414.00. I have awarded half of the invoice to the landlord which I consider to be a reasonable division of the repairs required given that there is no further breakdown in the invoice.
Because Freedom Property Management Limited Wesley Stephen Smith has substantially succeeded with the claim I have reimbursed the filing fee.
