The landlord, represented by Ms Hale, attended the hearing by video but could not activate sound. She attended by telephone instead. The tenants did not join the video link. The Tribunal called both tenants on the cell phone numbers provided for them in the application but the calls did not connect.
The landlord has applied for termination of the tenancy, rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy. Termination of the tenancy and rent arrears owed
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
The tenancy became periodic once the fixed term expired on 31 May 2025. From 7 June 2025 onwards, arrears started to accumulate and from 2 July 2025, no rent was paid. I asked the landlord whether the tenants were still living at the premises or whether they might have abandoned the premises. The landlord provided evidence that they inspected the premises on 4 July 2025. The tenants were not present and the landlord observed that all the furniture was gone. The landlord emailed the tenants to ask if they had vacated and wanted to give notice ending the tenancy. The tenants replied advising that they had removed their furniture because of a cockroach infestation. The tenants also advised that if they vacated the property, they would let the landlord know. With rent arrears increasing, the landlord conducted a further inspection on 8 August 2025. Nothing had changed. The tenants were not present and the premises were in the same condition with no furniture. The landlord again emailed the tenants to ask if they wanted to end the tenancy, but received no reply.

The landlord provided water rates invoices which prove the amount owing at the end of the tenancy.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
