The applicant seeks the following amounts: a) Rent arrears to 3 July 2025 in the sum of $6,760; b) $250 for a locksmith invoice; c) $258 for enforcement of the termination order; d) $225.98 for rubbish removal and replacement light bulbs; e) $734.32 for the replacement of a mattress, including removal and disposal of the old mattress; and f) $343.85 for general cleaning. g) $28.00 for the application filing fee Rent arrears

The applicant has provided a rent summary showing the amount owing to that date. I am satisfied that this record is accurate.

The respondent submits that they should only be liable for rent until 1 July 2025, as they were engaged in discussions with the applicant regarding returning possession on that date. The applicant says that discussions were underway for access to the property on 1 July, but the respondent ceased responding.

An enforcement order requires lodgement with the court bailiff and takes some time to action. This tenancy was terminated on 18 June 2025, and by at least 1 July 2025, the respondent had not complied with the termination order.

I am satisfied that the steps taken by the applicant to obtain possession were reasonable. Accordingly, rent is properly payable up to 3 July 2025. The claim for rent arrears is therefore awarded. Locksmith costs

The applicant seeks $250 for a locksmith invoice.

The respondent states that the keys were left on the table at the property on 1 July 2025. The applicant confirms this. The applicant says the locksmith was engaged in anticipation that the keys would not be returned, and to provide access for the bailiff and to change the locks.

It is unclear why the applicant did not provide the bailiff with the keys to obtain access, at which point the keys left at the property would have been discovered.

I accept the respondent’s evidence on this point and find that the locksmith costs were unreasonably incurred. This claim is dismissed. Bailiff enforcement costs

The applicant seeks $258.00 for bailiff enforcement charges.

I am satisfied that this cost was incurred in enforcing a Tribunal order. This amount is awarded. Rubbish removal, cleaning, and light bulbs

The issue is whether the respondent is liable for the costs of rubbish removal, cleaning, and replacement light bulbs.

Under section 40(1)(e)(iii), a tenant is required to leave the premises in a reasonably clean and tidy condition and remove all rubbish at the conclusion of the tenancy. I have reviewed the photographic evidence of the property at the end of the tenancy and am satisfied that the respondent was in breach of this obligation.

I am also satisfied that the costs claimed were reasonably incurred. The amounts sought for rubbish removal, general cleaning, and replacement light bulbs are therefore awarded. Mattress replacement

The applicant claims $734.32 for the replacement of a mattress, including removal and disposal of the old mattress.

The respondent submits that the mattress did not need to be replaced, and that the staining was caused by coffee grounds.

Having reviewed the evidence, I am satisfied that the mattress was soiled to an extent that replacement was reasonable.

However, I must account for betterment and depreciation. The IRD depreciation guide does not provide a specific useful life for mattresses. The tenancy commenced in 2020, and the applicant has provided evidence that the mattress was purchased at that time.

I am satisfied that an award of 50% of the replacement cost appropriately accounts for betterment and depreciation. Accordingly, the sum of $367.16 is awarded. Filing fee
