Reasons

Both parties attended the hearing on 27 February 2026 via videoconference.
The tenancy started on 23 April 2023 and ended on 23 August 2025.
The landlord applied for water rates arrears, compensation, refund of the bond and reimbursement of the filing fee following the end of the tenancy.
The tenant did not dispute the water rates arrears of $148.53, compensation of $550.00 for the damage done to the master bedroom interior wall, $1,286.60 for replacement of lounge carpet, and $165.00 for carpet cleaning and stain removal.
The tenant disputed $726.66 for the damage on the external wall panel outside the kitchen wall. The tenant denied causing damage to the gib board and highlighted that there were cracks visible on other wall panels as well.
The landlord claimed that the tenant may have caused the damage while using a weeding equipment of some sort.
For damage claims, a landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. The landlord must also prove that the damage was the result of an act or omission by the tenant or by a person for whose actions the tenant is responsible for.
The landlord could not establish on the balance of probabilities that the damage was caused by the tenant or anyone whose actions the tenant is responsible for.
Therefore, I dismiss the claim for the exterior wall panel.
Because the landlord has substantially succeeded with the claim, I order the tenant to reimburse the filing fee.
