- The landlord attended the hearing which was held by teleconference. The tenant didn’t attend and couldn’t be reached on the number given in the Notice of Hearing, which was properly served.
- The landlord has applied for rent arrears and compensation following the end of the tenancy.
How much is owed for rent?
- The tenancy ended on 30 September 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy.
- Since the end of the tenancy the tenant has been making regular payments. The landlord has applied those to debts said to be owing at the end of the tenancy. Those debts are not proved, so I have allowed a credit for those payments in this Order.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- Exit inspection photographs provided by the landlord show that the tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.
- The lawns were badly overgrown.
- The amounts ordered are proved buy the landlord’s work order records .
Is the tenant responsible for the damage to the premises?
- A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
- A comparison of the entry and exit inspection photographs provided by the landlord proves that extensive damage was caused to the premises during the tenancy. There was damage to walls and doors made by drawing and holes, carpet was badly stained. A cabinet required extensive repair.
- The cost of the re[pair work is proved by the landlord’s work order records.
- Allowance is made for depreciation of depreciable items such as carped and interior paintwork.
