Reasons
- This application was scheduled to be heard by teleconference. I was unable to connect with the tenant at the number provided for her. However, I am satisfied that she has received notice of this hearing and so it proceeded in her absence.
- The landlord has applied for rent arrears and compensation following the end of the tenancy.
How much is owed for rent?
- The tenant gave notice to end the tenancy on 10 October 2025. At that date the rent record shows that she owed $1,851.00 in rent arrears. Her last payment of rent was $400.00 on 10 September 2025.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The photographs show that the tenant had not cleaned the kitchen cupboards.
- The photographs also show that she left rubbish outside the house including a swing set, dog kennel and scooter.
- There was also a significant amount of rubbish left inside the house and the garage.
- I have reduced the amounts claimed for removal of the interior rubbish and the cleaning of the kitchen cupboards to amounts that I consider more accurately reflect the amount of work required from the evidence provided.
Is the tenant responsible for the damage to the premises?
- A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
- I accept the evidence showing that during the tenancy the living room window was broken and walls were damaged in the entryway and bedroom 2.
- The amounts ordered to remedy these issues are proved.
- I am dismissing the claim for the cost of a replacement kitchen cabinet knob because the photos show that these cabinets are ageing and I consider that a knob falling off is fair wear and tear. C ter Haar 05 February 2026
