- The applicant has provided rent records evidencing the arrears. I am satisfied that these records are accurate, and the amount claimed for rent arrears is awarded.
Is the respondent liable for the cleaning and rubbish removal costs?
- The applicant has provided photographic evidence showing that the tenant failed to leave the premises in a reasonably clean and tidy condition and failed to remove all rubbish at the end of the tenancy. This constitutes a breach of the tenant’s obligations under section 40(1)(e)(iii) of the Residential Tenancies Act 1986. The cleaning required was for the whole house, including the rangehood and kitchen cupboards.
- I am satisfied that the tenant was in breach of these obligations, and the amounts claimed for cleaning and rubbish removal are awarded.
Is the respondent liable for the damage repair costs?
- The applicant has also provided photographic evidence of damage to a door and a window, described as impact damage. On the balance of probabilities, I am satisfied that this damage was caused by the tenants. The repair costs, as supported by the invoices provided, are therefore awarded.
Is the respondent liable for the carpet replacement costs?
- In relation to the carpet, the applicant states that replacement was required and that the carpet was eight years old. Photographs show some staining; however, it is not clear that replacement was necessary. In any event, the applicant calculated depreciation on the basis of a 10-year useful life. The Inland Revenue Department depreciation guide indicates an eight-year useful life for residential carpet. Accordingly, the carpet was fully depreciated. As the landlord elected to replace the carpet in circumstances where replacement was not clearly required, the cost of replacement is not recoverable from the tenant. This claim is dismissed.
