Reasons

- The tenant was telephoned on the phone number provided but the phone call went unanswered. I am satisfied the tenant was properly served with notice of the hearing. The hearing proceeded in her absence.
- The landlord has applied for rent arrears, compensation and reimbursement of the filing fee following the end of the tenancy. Relevant legal considerations
- The relevant law that applies is found in the Residential Tenancies Act 1986 (RTA).
- With any claim before the Tenancy Tribunal, the Tribunal applies the usual civil law standards and expectations. That includes a requirement that the applicant establish their claims on the balance of probabilities. The balance of probabilities means more likely than un-likely, or in mathematical terms, has a fractionally more than 50% likelihood. The Tribunal does not need to be certain or very sure about any claim, only that what is claimed is likely. This obligation carried by the applicant is referred to as the “burden of proof”. Independent witnesses, corroborating documents and photographs are an important part of discharging this burden.
How much is owed for rent?
- The tenant must pay the rent as and when it is due and payable under the tenancy agreement. 1 On 29 January 2026 the Tribunal made an order terminating this tenancy for abandonment. This was a fixed term tenancy. The contractual end date was 22 January 2026. Section 61 (3) of the RTA says: (3) A tenant who abandons the premises shall, notwithstanding any rule of law to the contrary, be liable to pay the rent for any period up to and including, but not after, the following date: ...(b) in the case of a fixed-term tenancy, — (i) the date of the expiry of the term; or (ii) the date of commencement of a new tenancy of the premises, — whichever is the earlier.
- The landlord secured a new tenancy to commence on 14 January 2026. Accordingly, the tenant is liable for rent to 13 January 2026. The amount ordered is $2,658.00 which reflects that the bond has been paid to the landlord 1 and deducted from the rent arrears. The Law – tenant’s obligations at the end of the tenancy
- At the end of the tenancy the tenant must remove all his or her goods from the premises, leave the premises (including the land provided with the premises) reasonably clean and tidy, remove all rubbish, return all keys and security devices and leave all chattels provided for their benefit. 2 Cleaning and rubbish removal
- The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. Some general cleaning of the premises was required, the mattress and mattress protector needed cleaning. Rubbish removal was required. The amounts ordered are proved with photographs and invoices. I have not ordered compensation for the cleaning of the curtains as there was insufficient evidence that curtain cleaning was required. The amount ordered for cleaning is $592.25 (for cleaning, washing the mattress protector and rubbish removal), and $138 for mattress cleaning. Damage claims
- The landlord withdrew the claim in respect of the toilet roll holder. Filing Fee and Suppression
- Because the applicant has been wholly or partly successful in their claim, I have ordered that the respondent pay the applicant the application filing fee. 3
