Reasons
- Both parties attended the hearing which was conducted remotely. The landlord was represented by Mr David Culleton, director of the company.
- The tenant’s mother, Helen Jackson, appeared as his representative.
- The tenant had not received the original notice of hearing, despite it being sent to his email address. However, as a result of receiving the reminders, he and his mother had contacted the Tribunal and were able to appear. Ms Jackson’s application to appear as a representative had not made it to the Tribunal file, but there was no objection to her speaking on her son’s behalf.
- The landlord has applied for rent arrears. There was a lack of certainty about the date of termination, but at the hearing it was agreed that it was 19 December 2025 and the amount of rent owing to that date is $3,030.00.
- It was also agreed that the tenant was responsible for the repair of a window that was damaged. An invoice for $327.75 for window repair was submitted.
- The amounts ordered are proved.
- The rental agreement shows two other names as tenants. Mr Jackson said that the other two tenants moved out some time ago. He accepts responsibility for the unpaid rent and the window. I am satisfied that there is therefore no need to join the other tenants. And, according to the information at the bond centre, the bond is in Mr Jackson’s name alone.
- Because Little Havana Limited has wholly succeeded with the claim I must reimburse the filing fee.
