Reasons
- The hearing was held on 31 March 2026 via video conference.
- The tenant did not attend the hearing and has not been in contact with the landlord for some time. Ms Davis, representing the landlord, appeared and provided evidence.
- Ms Davis confirmed that the last contact with the tenant occurred on 16 October 2025, shortly before the tenancy ended on the week of 22 October 2025. That communication was via email, including correspondence relating to tenancy matters such as completion of the end-of-tenancy form. Since that time, the landlord has had no further contact with the tenant.
- Ms Davis advised that the contact details held on file are outdated, with the most recent phone number dating back several months. Despite attempts to communicate, the tenant has not responded
- Ms Davis also indicated that the landlord believes the tenant has relocated to Australia and may no longer be residing in New Zealand. As a result, recovery of the debt may be difficult in the short term, although obtaining an order would allow enforcement action should the tenant return.
- Based on the exit inspection and photographic evidence, she agreed with my assessment that the tenant appears to have left New Zealand in a rush, leaving behind a significant number of belongings and failing to properly clean or vacate the premises in a reasonably clean and tidy condition. The condition of the property at the end of the tenancy was such that cleaning was required throughout the house, including the kitchen cupboards, exterior areas, and grounds.
- I am not aware of any bond held in the Bond Centre.
- The landlord has applied for rent arrears, compensation, and reimbursement of the filing fee following the end of the tenancy.
How much is owed for rent?
- The tenancy ended on 27 October 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
- The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
- The amounts ordered are proved. Filing fee
- Because Kāinga Ora–Homes And Communities has wholly succeeded with the application, I must reimburse the filing fee.
