This tenancy commenced on 26 June 2022 and concluded on 17 November 2025.

The applicant seeks $1,207.50 for damage to the vanity, wooden floor, and benchtop, $126.50 for carpet shampooing, and $281.75 for cleaning.

In support of the application, the applicant has provided exit inspection photographs showing damage and that the property was well short of the standard required under section 40(1)(e)(iii) of the Residential Tenancies Act 1986, namely the obligation to leave the premises in a reasonably clean and tidy condition and to remove all rubbish at the conclusion of the tenancy. However, it is unclear from the evidence provided that carpet shampooing was required. Accordingly, the cleaning cost is awarded, and the claim for carpet shampooing is dismissed.

The applicant has also provided evidence showing that the benchtop, floor, and vanity were extremely worn. The tenant submits that this amounts to fair wear and tear, whereas the landlord submits that it constitutes intentional damage. The benchtop appears disproportionately stained, the vanity has been water damaged, and the floors have a lot of overuse damage resulting in scratching and deterioration.

The nature of the damage appears to have developed gradually over the course of the three-year tenancy albeit at an accelerated pace due to a lack of care and could reasonably have been identified during that period. As such, I do not accept the tenant’s submission that the damage amounts solely to fair wear and tear. While the damage is consistent with wear and tear in nature, the extent and severity of it indicate an extremely accelerated rate of deterioration, likely arising from a lack of reasonable care in the use of the premises.

In my view, both parties have contributed to the loss and deterioration. The tenant due to a lack of care and the landlord by failing to intervene at an earlier point during inspections. Accordingly, I consider it appropriate to award half of the amount claimed.

I do not accept the tenants’ submissions that the repair costs are unfair or exceed market rates. The costs claimed appear reasonable, particularly given the extent of the work undertaken.

In relation to the application for suppression, I am not satisfied that there are special circumstances such that the interests of either the applicant or respondent outweigh the public interest in open justice. Accordingly, the application for suppression is declined.
