- The landlord’s remaining claim for repair costs totalling $44,766.00 plus GST is adjourned. I intend to deal with this claim on the papers once the landlord’s insurers have determined the policy response. This will enable the Tribunal to properly apply the statutory provisions relating to tenant damage. Filing Fee
- I have decided to award the filing fee at this stage. There is clearly damage to the premises, so that it is likely the landlord’s application will be at least partly successful.
