- This application was scheduled to be heard by video conference. The tenant did not connect to the Teams link provided to her and nor did she ring in to the hearing as directed in the Notice of Hearing that was sent to her. The hearing proceeded in her absence.

- The Tribunal Order for application 5379967 and dated 23 December 2025 terminated the tenancy and ordered the tenant to pay $2,250.00 in rent arrears and $28.00 for the filing fee. The rent arrears initially amounted to $5,250.00 but the $3,000.00 bond was applied to that total.
- The tenant did not leave the premises until 2 January 2026 and so she is required to pay more rent for the period 26 December 2025 to 2 January 2026 - $857.14.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
- The photographs show that the tenant did not remove all of her belongings and left a significant amount of rubbish behind.
- I also accept the evidence that she did not return the keys to the premises.
- The amounts ordered to remedy these issues are proved.
Is the tenant responsible for the damage to the premises?
- A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
