Reasons
- The case commenced before me today by teleconference. The tenant failed to make himself available. A number of attempts were made to contact him by phone.
- The landlord has applied for termination of the tenancy and possession.
- The tenant was provided with a notice giving ninety days’ notice of termination.
- Landlords are entitled to terminate a periodic tenancy with a 90 day written notice.
- The notice was issued and clearly states the requirements that the ninety day notice was to end on the 2 January 2026. The tenant has failed to move out.
- I am satisfied that the notice is not retaliatory. The landlord is required to carry out significant renovations and repairs that the tenant has caused at the property, including but not limited to flooding and fire damage. The bathroom needs renovation as the does the kitchen.
- Whilst the landlord only seeks payment of $250.00 for two louvered doors in the kitchen he claims to have ‘written off’ the significant other damage to the property.
- I am satisfied that the notice has been carried out in terms of the legal requirements and therefore order termination and possession immediately.
- I also order the refund of the bond to cover the rent arrears as at todays date and costs of the two doors.
- Because Alister Francis Young, Marion Jessie Dent has wholly succeeded with the claim I must reimburse the filing fee.
