The tenant did not connect to the hearing by way of the link provided in the notice of hearing emailed to her to the email address provided in the application form. The tenant was phoned on the phone number provided but the phone call went unanswered.

This application has been filed within two months after termination of the tenancy. The RTA requires that the tenant is served in prescribed ways, including by post to an address for service the tenant has provided in writing to the landlord or personally or to an email address for service provided by the tenant. 1

The tenant has not been served in accordance with the provisions of the RTA. The tenant has not provided a physical or email address for service to the landlord. I’m satisfied that all reasonable efforts have been made to serve the tenant in accordance with the RTA and there are no other reasonable efforts that could occur to serve the tenant in accordance with the RTA.

In the circumstances I proceeded on the basis that service of the claim to the email address that the tenant used to give notice to terminate the tenancy was likely to have brought notice of the hearing to the tenant’s attention. I have treated the tenant as served by substituted service to that email address and have dispensed with any further service on her. 2

The landlord has applied for rent arrears, compensation, payment of the bond, and reimbursement of the filing fee following the end of the tenancy. Relevant legal considerations

The relevant law that applies is found in the Residential Tenancies Act 1986 (RTA).

With any claim before the Tenancy Tribunal, the Tribunal applies the usual civil law standards and expectations. That includes a requirement that the applicant establish their claims on the balance of probabilities. The balance of probabilities means more likely than un-likely, or in mathematical terms, has a fractionally more than 50% likelihood. The Tribunal does not need to be certain or very sure about any claim, only that what is claimed is likely. This obligation carried by the applicant is referred to as the “burden of proof”. Independent witnesses, corroborating documents and photographs are an important part of discharging this burden.

The tenant must pay the rent as and when it is due and payable under the tenancy agreement. 3 The tenancy ended on 12 January 2026. The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. The landlord claimed rubbish removal and cleaning costs. Invoices and post-tenancy photographs were provided in support of the claim. The amounts ordered are proved. Bond

The bond is to be paid to the landlord immediately to offset the amount’s ordered. Filing Fee

Because the landlord has been wholly successful in their claim, I have ordered that the tenant reimburse the filing fee. 5
