The landlord attended the hearing and was represented by a property manager. The tenant did not answer the call I made to her phone.

The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 21 December 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy.

There is a previous mediated order for rent arrears and the filing fee. The previous order is incorporated into this order for enforcement purposes. I have made an allowance for the filing fee.

Did the tenant comply with her obligations at the end of the tenancy?

Tenants must remove their rubbish at the end of the tenancy. See section 40(1)(c) and (e)(iii) Residential Tenancies Act (RTA).

The RTA does not require the premises to be provided or returned in a spotless or an immaculate condition. The standard is based on what an average bystander would consider reasonable, not on the subjective opinions of the landlord and tenant. There is no scientific way to determine what is reasonably clean and tidy, and the Tribunal must evaluate the evidence available, and in particular inspection reports and photographs.

This is the landlord’s claim to prove. The landlord provided me with photos from the start of the tenancy, which showed a big pile of building materials and rubbish was already piled in the garden. I have the photos taken at the final inspection showing the rubbish there at the end of the tenancy. The landlord has also provided me with emails where the tenant has explained which rubbish is hers and what was there at the start of the tenancy. The landlord said she provided a copy of the explanation to the person removing the rubbish so that only the tenant’s rubbish was removed by truck and taken to the tip. I have not heard from the tenant. The landlord’s process to ensure the tenant is only charged for her rubbish seems reasonable to me. This claim is proved and allowed.

Is the tenant responsible for the damage to the premises?

There is a claim for replacing a cover which is part of the heat pump. The landlord must prove that damage occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

The landlord provided me with a photo taken during the tenancy showing the cover, and a photo taken at the final inspection where the cover is missing. I find the damage is more than fair wear and tear, and the tenant has not disproved liability for the damage. The amount ordered is proved. Other orders

Because the landlord has substantially succeeded with the claim I have reimbursed the filing fee.
