- This application was scheduled to be heard by video conference. The tenant did not connect to the Teams link provided to him and nor did he ring in to the hearing. The hearing proceeded in his absence.
- The background to this claim is that the tenant was evicted on 17 November 2025. A previous order (53448878) deals with the termination of the tenancy and rent arrears to that date.
- The landlord now makes a further claim in the Tribunal against the tenant seeking compensation relating to the condition of the premises at the end of the tenancy and reimbursement of the filing fee.
Did the tenant comply with his obligations at the end of the tenancy?
- At the end of a tenancy a tenant is required to leave the premises reasonably clean, both inside and outside, remove all rubbish and to leave behind all chattels provided for their benefit.
- I accept the photographic evidence which shows that the tenant left the premises in a dirty condition, there was rubbish left behind, the garden was overgrown, the carpet was not left reasonably clean, and the rangehood cover and filter was missing.
- I accept the costs associated with remedying these issues and the tenant is required to pay these costs.
- I note that with regard to the rangehood, the landlord replaced the rangehood at a cost of $585.00. I am requiring the tenant to pay $150.00 towards this cost to take into account depreciation. Filing fee reimbursement
