Reasons
- The landlord attended the hearing by teleconference. The tenant did not attend. The Tribunal attempted to contact the tenant on the telephone number provided in the application, but without success. I am satisfied that the tenant was properly served with notice of the hearing and that it is appropriate to proceed in the tenant’s absence.
- This tenancy commenced on 30 August 2025. The rent was $680.00 per week.
- The landlord initially applied for termination of the tenancy. By the date of the hearing, the tenant had vacated the premises. I accept the landlord’s evidence that the tenancy ended on 28 February 2026. As the tenancy has already ended, no termination order is required. Rent Arrears and Gas Charges
- Section 40(1)(a) of the Residential Tenancies Act 1986 (“the Act”) requires a tenant to pay rent when it falls due and to continue paying rent until the tenancy ends.
- The landlord produced a rent summary showing that, after all payments were credited, rent arrears of $7,760.00 remained owing at the end of the tenancy. I am satisfied that the rent summary is accurate and that this amount is due.
- The landlord also claims Rockgas charges of $179.35 and $348.00, totalling $527.35. Utility charges that are separately metered or charged according to consumption are the responsibility of the tenant under section 39 of the Act and the terms of the tenancy agreement. Invoices were produced and I am satisfied that these charges relate to the tenant’s period of occupation. Compensation Claims
- Section 40(1)(e) of the Act requires a tenant to leave the premises reasonably clean and tidy and to remove all rubbish and personal belongings at the end of the tenancy. Section 40(2)(a) further provides that a tenant is liable for damage caused intentionally or carelessly by the tenant or by persons lawfully on the premises.
- The landlord seeks compensation for exterior wall damage in the amount of $473.00. Photographs and an invoice were provided. The evidence establishes that the damage was beyond fair wear and tear and required repair. I am satisfied that this claim is proved.
- The landlord seeks $260.00 for removal of items left at the property and $214.00 for Flexibin hire. The photographs show that the tenant left belongings and rubbish at the premises. These costs were reasonably incurred as a direct consequence of the tenant’s failure to remove their possessions at the end of the tenancy. I am satisfied that both claims are established. Filing fee
- As the landlords have wholly succeeded with the claim, I must order the tenant to reimburse the filing fee.
