Reasons
- The landlord attended the hearing. The tenant did not attend the hearing or request an adjournment.
- The tenant has been served notice of the hearing to an email address which is an address for service on their tenancy agreement. Because service requirements are in accordance with the Residential Tenancies Act, 1986, I conducted the hearing in the tenant’s absence.
- The landlord has applied for termination of the tenancy, rent arrears compensation and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord said that no rent has been paid since January this year. The tenants have not responded to any of the landlord’s attempts to get in contact with them in this time. Recently a plumber attended the premises and on entering the premises discovered the power had been disconnected, the freezer had defrosted and the fridge and freezer contained rotten meat and food blown with maggots.
- The landlord believes nobody has lived at the property for several weeks.
- In the circumstances I am prepared to terminate the tenancy immediately.
- The landlord provided rent records which prove the amount owing at the end of the tenancy is $5,497.14.
- The landlord is seeking reimbursement for a window that was broken by the tenant and then repaired by the landlord during the tenancy.
- The damage goes beyond fair wear and tear and the tenant has not disproved carelessness.
- The claims and amounts awarded are proved.
- Because Eves Realty Limited As Agent For The Tesoro Trust C/- Simon & Bronwyn has wholly succeeded with the claim I must reimburse the filing fee.
