Order
- Michelle Knights and Karen Lagatule must pay Property Empire Limited As Agent For Sopheap Tuy $2,218.48 immediately, as set out in the table below.
- The Bond Centre is to pay the bond of $3,600.00 (BN-25095904) to Property Empire Limited As Agent For Sopheap Tuy immediately.
Reasons
- Both parties attended the hearing held on 27 May 2026 by phone. Michelle Knights attended the hearing but did not have authority to represent Karen Lagatule. An attempt was made to join Karen Lagatule to the hearing by telephone, but the call went to voicemail.
- This was a fixed term tenancy that began on 19 January 2026 and was due to end on 14 January 2027.
- The tenants asked to end the tenancy early and the landlord secured a new tenancy that started on 1 April 2026. The tenants are liable for rent arrears to 31 March 2026.
- The landlord has applied for rent arrears and has provided rent records which prove the amount owing.
- The landlord sought a break lease fee of $776.20 which I determine is a reasonable cost. That amount is awarded.
- The landlord agreed to a payment of $42.86 which together with two days where rent was not sought at the beginning of the tenancy equates to $300.00 for cleaning that the tenants carried out.
- Because Property Empire Limited As Agent For Sopheap Tuy has wholly succeeded with the claim I must reimburse the filing fee.
