Representatives of the landlord attended the hearing. The tenants did not attend.
The landlord has applied for compensation and reimbursement of the filing fee following the end of the tenancy. The landlord has received the bond from the Bond Centre. The bond amount has been applied to the debt in order 1 above.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The landlord provided extensive photographs and receipts. The amounts ordered are proved.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
The following damage was caused during the tenancy: extensive damage to carpets and walls, damage to aluminium joinery. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
The landlord provided extensive photographs and receipts. I have not awarded the full amounts claimed. Some of the aluminium repair was (seals) was landlord maintenance. The carpet claim has been depreciated having regard to the useful life of carpet. The painting claim covered full repaint of walls and ceilings. Having regard to the photographs and depreciation, I have awarded two thirds of the amount claimed.
The landlord also claimed $2,386.66 for a range of miscellaneous repairs, charged over two builder’s invoices. Photographs were provided to establish most of the claims such as skirting damage, door handles removed, curtain rails damaged, toilet seat removed and cracked cistern. Other items, such as painting the rear fence appeared to be maintenance issues. I have reviewed all of the photographs and award $1,900 for the general repair items.
As the landlord was the successful party, I also award reimbursement of the Tribunal application fee.
