Reasons

Both parties attended the hearing.
The landlord has applied for rent arrears and the following costs: • Removal of rubbish: $260.00 • Carpet cleaning/ damage: $105.00 • Repair the back door/cat door: $360.00 • Water blasting the exterior: $224.00 • “Emotional damages”: $1500.00
Ms Lanurias also claimed for two mattresses that she said were damaged but she withdrew that claim at the hearing.
Mr Winiata accepts the claim for rent and the claim for the carpet cleaning/damage. He also accepts that he left rubbish behind at the end of the tenancy and that his dog broke the cat door. In the circumstances I consider the amount claimed to remove the rubbish is reasonable. Ms Lanurias did not provide evidence to support the cost to remedy the cat door. In the circumstances I consider the sum of $100.00 reasonable to compensate her for that damage. Mr Winiata disputes the other claims.
Ms Lanurias claims that the exterior, including the paths, required water blasting to remove dirt. Mr Winiata disputes that the water blasting was required claiming that his father had done the cleaning work before the tenancy ended. Ms Lanurias has the onus to establish her claim and she did not provide any photographs or other evidence to support her claim that the water blasting was required. Neither did she provide evidence to support the amount she is claiming for the water blasting. However, Mr Winiata accepts that the did leave some dog faeces on stones at the property at the end of the tenancy. In the circumstances I consider the sum of $100.00 reasonable to compensate Ms Lanurias for the water blasting claim.
Ms Lanurias’ claim for compensation for ‘emotional’ damage is dismissed. Being a landlord is a business and there will often be some additional cleaning and other work required at the end of a tenancy. This is an ordinary business expectation and the nature or extent of the work required here is not out of the ordinary or could reasonably expect to attract an award of general damages for stress or other emotional consequences.
Ms Lanurias has been mostly successful in her claims, and I consider this an appropriate case to award her payment of the Tribunal application fee.
On 6 April 2023 the Tribunal made an order relating to this tenancy for compensation payable to Mr Winiata and the Tribunal application fee. It is appropriate and sensible to incorporate the award made in the previous order into this order.
