Mr & Mrs Calder represented Redlac Investments Ltd at the hearing today. There was no appearance by the tenant.
The landlord’s rent record establishes rent arrears of $7,051.78 to 6 April 2023.
Water rates are owed for the period 15 August 2022 – 2 March 2023 ($157.56 per the Whangarei District Council invoice) and from 3 March to the end of the tenancy. The landlords read the meter at the end of the tenancy, and have correctly calculated the cost of water used.
The claim for water rates is proven.
Tenants must leave the premises reasonably clean and tidy at the end of the tenancy 1 .
Mr & Mrs Calder’s photographs show that the premises were left in a very unclean and untidy condition at the end of the tenancy.
The amount claimed for cleaning is proven, and is fair and reasonable having regard to the evidence provided.
There was damage to the property during the tenancy: a. Broken window pane in bedroom; b. Two holes in the floor in the wardrobe, and two holes at the top of the wardrobe. c. Water damage to the flooring in front of the ranchslider.
I was provided with a photograph of the broken window pane, and photographs of the holes in the wardrobe.
The damage is beyond fair wear and tear.
I accept Mr & Mrs Calder’s oral evidence that the flooring directly in front of the ranchslider door was water damaged. I agree with their argument that the most likely cause of this is that the tenant failed to keep the ranchslider closed in rainy weather.
The cost of re-glazing was $206.80 per an invoice from Independent Glass.
The cost of repairs to the wardrobe floor and floor in front of the ranchslider was $562.50 per an invoice from Level Concept Construction.
The tenant is liable for these costs.
The landlord has been successful in this application and I must also award the landlord the filing fee of $20.44. 1 Section 40(1)(e)(iii) Residential Tenancies Act 1986
The bond has been released to the landlord.
