At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish and return all keys.
Having seen the photos, I find that the tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The tenant did not return the keys.
I order the tenant to pay the landlord $625.00 for cleaning and $408.25 for lock replacement.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
The landlord had sought $1,428.22 for the damages caused in the master bedroom. The landlord had an invoice for the repairs.
However, the landlord did not have photos showing the state of the master bedroom from the beginning of the tenancy.
As the landlord was unable to prove that the damage had occurred during the tenancy and was unable to show the state of the bedroom originally, I decline to grant this claim. Filing fee reimbursement
Because Pauline Barbara Stables has substantially succeeded with the claim, I order the tenant to reimburse the filing fee.
