The landlord attended the hearing this afternoon by telephone.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy. Rent
The tenancy ended on 29 March 2023 pursuant to an order of the Tribunal. The tenant asked for more time to leave. The landlord agreed to this and asked the tenant to contact him when she was ready to leave. After this the tenant did not respond to the landlord’s phone calls or text messages. The landlord visited the property on 21 April 2023 and found it was empty.
I find that the tenant remained in occupation of the premises until 21 April 2023 and award rent to this date, pursuant to section 60 of the Residential Tenancies Act 1986. Cleaning and keys
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.
The tenant did not leave the premises reasonably clean and tidy. There was a need for some cleaning inside cupboards. I award 1 hour of cleaning.
The carpets were stained at the end of the tenancy and needed cleaning.
The tenant did not return the keys. The landlord had to change the locks to make the property secure. Filing fee
The landlord’s application has been partly successful. I award the filing fee. Procedural note – request for adjournment
The tenant requested an adjournment on the day of the hearing. The tenant said she was in Australia and would be boarding a plane at the time of the hearing (the departure time was in the early evening).
