How much is owed for rent and water rates arrears?

The tenancy ended on 26 June 2023 by Tribunal Order for termination. The Tenant did not vacate until the 18 July 2023. The landlord provided rent records and water records which prove the amount owing at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The Landlord submitted they cleaned the whole house which included the ceilings, light fittings, cupboards, stove, walls and disposal of the rubbish. The Landlord provided an invoice for cleaning and photographs of dirty kitchen cupboard surfaces, toilet, drawers, the oven, shower, door surfaces, window sills, rubbish in the garage and wall surfaces. There was rubbish in the garden, garage and outside of the house which included basketballs, a bucket, a tyre, plastic chairs, laundry, a bed base and bottles.
The Landlord arranged for a second-hand valuer to assess the items left behind in the garage and a letter was provided confirming there was no re-sale value. The items included the bed base, bicycle, rubbish bag and game table.
The Landlord claimed for labour required to remove and dispose of the rubbish on 29 and 31 August 2023. An invoice was provided for the rubbish tip receipts.
The lawns required mowing as the grass appeared overgrown. Photographs of the grass and an invoice for the lawnmowing was provided.
The Landlord also claimed for cleaning the stained carpets. The Tenant had a cat and five children occupying the house. The carpet required deodorising due to the smell of cat urine and carpet stains. Photographs of the stains and an invoice for the carpet cleaning was provided.
The Tenant did not return the keys and advised the Landlord they had lost them. A locksmith was required to re-key the front and back door. An invoice was provided for the locksmiths work.
The amounts ordered are proved.
The Tenant removed the curtains in the property during the tenancy advising the Landlord she was going to clean them. They were not present at the end of the tenancy. There were approximately six sets that required replacing and the curtains were approximately six months old at the start of the tenancy. Photographs from a mid-tenancy inspection report showed the curtains in the bedrooms and invoices for the new curtains and curtain tracks were provided.
The amounts ordered are proved.
As Rentex Limited As Agent For Gnb Properties Ltd has wholly succeeded with the claim the Tenant must reimburse the filing fee.
The Landlord has not sought name suppression so an Order has not been made.
