How much is owed for rent?

The Tenant gave two weeks to end the Tenancy. The Tenant was gone from the property at the end of the two weeks, he says. But the keys, which he left with his sister, were not returned until on or about 9 September 2023. I think the Tenant could have returned the keys himself, but he says he was experiencing hardship. The Landlord could have asked for the keys but didn’t. On balance, I find the Tenant is responsible, and I consider there was not much the Landlord could have done to mitigate its liability. The law requires 28 days, and I do not think the Landlord has delayed unnecessarily.

The landlord provided rent records which prove the amount owing as at 15 September 2024: $2,360.00 The rent summary is not disputed. I award the rent amount sought.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The Tenant claims to have had the carpets professionally cleaned prior to leaving the premises. The Landlord was not satisfied with the clean and had another professional carpet cleaner do the job.

The cleaning involved hot water extraction for carpets in the lower lounge/dining area, hallway, first-level lounge, and stairs, costing $156.

Stains were treated throughout, particularly in the upstairs bedrooms and lower lounge, with mostly positive results for $163.

The effectiveness of treating urine stains in the lounges was uncertain until dry. The process took 1 hour and 10 minutes. Additionally, damaged carpet in the lower and third-storey lounges was repaired using donor carpet from an upper bedroom wardrobe.

The Landlord has provided photographs after this clean, but I do not have photographs of what the carpet looked like in the lower lounge/dining area between cleans. I cannot award the Landlord’s claim for having the lower lounge/dining carpet cleaned. I award $258.00

Because Staircase Property Management Limited has wholly succeeded with the claim I must reimburse the filing fee of $20.44.
