The tenancy was due to end on 30 October 2023 pursuant to that notice.
Mr Globits did not vacate the premises.
The landlord’s application initially sought termination, possession, and rent arrears. The application was filed on 21 November 2023. The landlord was aware of damage to that property at that time.
Mr Globits caused substantial intentional damage to the property.
On 30 November 2023 Mr Globits was trespassed from the property after police involvement. The landlord then gained possession of the premises and was able to assess the extent of damage.
The landlord’s amended application seeks repair, cleaning, and rubbish removal costs.
The hearing took place in Whangarei on 23 February 2024.
Ms Reynolds and Ms Hicks represented the landlord at the hearing. There was no appearance by the tenant. Repairs, cleaning, rubbish removal
Ms Reynolds provided a copy of the final inspection report including photographs.
The damage caused by Mr Globits includes: a. Walls and doors destroyed. b. Knifes stabbed into walls. c. Hot water cylinder stabbed. d. Three windows smashed. e. Rangehood smashed. f. Carpet cut and ripped (and also covered with debris and broken glass). g. Fibre box smashed and wiring cut. h. Heat pump damaged.
The property was left in a very unclean and untidy state. Ms Reynolds submitted that Mr Globits told her to get rid of anything he left behind at the end of the tenancy. Most of Mr Globits personal property was also intentionally damaged.
Ngatihine Health Trust Board has completed the following work: a. Cleaning. b. Rubbish removal. c. Boarding up the three broken windows so as to secure the property, then re-glazing the broken windows. d. Change of locks. e. Making safe the hot water cylinder, which was leaking due to being stabbed by the tenant, then replacing the cylinder. f. Repairing the walls, replacing doors, and painting. g. Replacing the rangehood. h. Repairing the heat pump.
Ngatihine Health Trust Board has quotes for the following work: a. Replace carpet. b. Replace fibre box and wiring.
Ngatihine Health Trust Board provided invoices and quotes supporting the above costs.
The claims are proven.
The property was newly re-decorated before the start of Mr Globits’ tenancy in June 2023. No depreciation applies to the replacement costs claimed.
Ms Reynolds confirmed that there are no rent arrears.
The landlord has been successful in this application, and I must also award the landlord the filing fee.
The bond will be released to the landlord.
