The landlord has applied for compensation, payment of the bond, and reimbursement of the filing fee following the end of the tenancy. The Tenant’s Obligations
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. The tenant must also replace standard light bulbs.
The tenant must not carelessly or intentionally damage the premises.

If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. The landlord has recovered the cost of the repairs from her insurer less the $1,000 excess. The landlord agreed that a fair apportionment between the pre-existing damage and the tenancy damage is 50/50 and so I have awarded $500 for the tenancy damage.
The amounts ordered were proved by the production of photographs and invoices.
The landlord has succeeded and so the tenant must pay the filing fee.
