Reasons

The landlord attended the hearing. The tenant did not attend the hearing.
Just prior to commencement of the hearing the tenant contacted the Tribunal to advise that she was unable to attend the hearing due to a recent family bereavement. The tenant did not seek an adjournment, so the hearing proceeded in her absence.
The landlord has applied for compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
The tenancy ended on 15 November 2023.
The landlord applied in relation to methamphetamine contamination. The premises were tested for methamphetamine contamination when the tenancy ended. Composite testing was carried out in November 2023 and detailed testing in January 2024.
The Gluckman Report concludes that there is no evidence of risk of harm from second or third hand exposure to methamphetamine residue measured at or less than 15μg/100cm² unless there is evidence to suggest that the premises have been used for manufacture. The test results show that none of the specific samples tested were above the Gluckman level. The highest level was
8μg/100cm² which is well below the Gluckman level. In addition, the landlord did not carry out any pre tenancy methamphetamine testing.
For these reasons the landlord’s claim in relation to methamphetamine testing and remediation is dismissed.
The landlord claimed in relation to cleaning. Some photographs were produced showing dirty walls and ceilings and a dirty dishwasher. No other photographs were produced to support the cleaning claim. I have reduced the claim sought by the landlord to $350.00 plus GST amounting to $402.50.
The landlord claimed for rubbish removal and produced photographs showing rubbish at the premises when the tenancy ended. I have awarded the costs for rubbish removal.
The landlord claimed for replacement of the front door. The photographs produced by the landlord showed that the glass panel in the front door was smashed. There was no evidence as to why this door was replaced for a new one instead of the glass being repaired. I have therefore allowed $200.00 toward replacement of the glass in the door.
The landlord claimed for a bedroom door that was missing and repair of the door frame which was cracked. I have allowed this claim.
The landlord claimed for installing the bedroom curtain track and curtain. A photograph was produced showing the curtain and track on the floor. I have awarded this claim.
The landlord seeks replacement of a gas bottle that was missing at the end of the tenancy. That amount is awarded.
The landlord claimed for repainting the interior of the premises and repairs to kitchen tiles, gate repairs and two exterior holes. None of these claims were awarded because there was no evidence produced to support the claims.
Because Barfoot & Thompson Limited Acting Agent For Bangsheng Wang has substantially succeeded with the claim I have reimbursed the filing fee.
