At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii) -(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1) (ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenant did not leave the premises reasonably clean and tidy.
The landlord has provided the Tribunal with photographs which show the property was unclean, with writing on painted walls, dirty marks, dust, mould and fly marks over the appliances. The microwave, rangehood, refrigerator and oven were dirty, shower floor was slimy and mouldy and carpets heavily stained.
The landlord also provided an invoice from Clean Planet for $500.25 dated 29 November 2023 for cleaning of the house.
The landlord claimed that the tenant left the lawns and gardens unkempt and overgrown. The Tribunal was provided with an invoice from WD’s Property Maintenance LTD, for $287.50 dated 29 November 2023 for lawns and weed eating, tidying up section and disposing of green waste.
In addition to the invoice the landlord provided photos which show the overgrown lawns and gardens.
I am satisfied that the landlord has proven their claim for the lawns and garden tidy up.
The property had a cockroach infestation at the end of the tenancy. There had been no advise from the tenant to the landlord about the infestation.
At the final inspection cockroaches were seen in the property. The landlord provided an invoice from Classis Carpet Care Services LTD for $170.00 for the cost of the pest treatment. The landlord provided photos of the dead cockroaches in the house.
I am satisfied that the landlord has proved their claim for cockroach infestation.
Because Barfoot & Thompson Limited - As Agent for Reza Sedehi and Yanling Chen has wholly succeeded with the claim I must reimburse the filing fee.
