Did the tenants comply with their obligations at the end of the tenancy?

At the end of the tenancy tenants must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) RTA.
The landlord provided me with photos taken at the end of the tenancy. I can see the house needed additional cleaning and carpet cleaning to remove stains. The gardens also needed weed eating and tidying.
The amounts ordered are proved.

Are the tenants responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
Two walls were damaged during the tenancy. The tenants have attempted repairs, but these were not all up to a reasonable standard and the paint used was not a match. It seems most likely to me the damage is more than fair wear and tear, and the tenants have not disproved liability for the damage. The amount ordered is proved.

How much do the tenants owe?

The bond is refunded to the landlord.
Because the landlord has substantially succeeded with the claim I have reimbursed the filing fee.
On 7 March 2024 the Tribunal made an order relating to this tenancy, for rent arrears to 15 March 2024 and terminated the tenancy. The previous order is incorporated into this order for enforcement purposes.
