The tenancy terminated on 20 May 2024 pursuant to a previous Tenancy Tribunal order 1 .
This application seeks vacated rubbish removal, cleaning, and repair costs, and water rates.
The hearing took place in Whangarei on 31 July 2024. Mr O’Connor represented the landlord. There was no appearance by the tenant.
Tenants must remove all rubbish and leave the premises reasonably clean and tidy at the end of the tenancy 2 .
Mr O’Connor provided photographs showing the premises after Ms Dacombe- Terry vacated. Ms Dacome-Terry left some bagged rubbish and several large items of furniture (a bed and a couch) behind. Some relative minor cleaning was necessary to bring the premises to a reasonably clean and tidy standard.
Mr O’Connor has minimised the cost of this work and the amounts claimed are reasonable and conservative.
Tenants are liable for damage beyond fair wear and tear that occurs during the period of the tenancy. Tenants are liable for damage caused by themselves and by anyone who is at the premises with their consent 3 . Mr O’Connor has proven that the following damage occurred during the period of this tenancy: a. Damage to window frame and cracked pane. b. Window stay broken. c. Several small chattels missing (cutlery tray, door stop, shower caddy, net curtains, etc). d. Minor damage to walls.
The amounts claimed for repairs, including re-glazing the broken window, and replacement of chattels, are proven and are fair and reasonable.
Water rates are owed to the end of the tenancy.
This order includes the amount of rent arrears awarded in the previous order, less the amount of the bond, which was released to the landlord at the end of the tenancy.
