Reasons

On 23 May 2024 I made an order terminating the tenancy.
This application seeks vacated cleaning, rubbish removal, and repair costs.
The hearing took place in Kaikohe on 5 December 2024. Ms van Engelen and Ms Maraki represented the landlord. There was no appearance by the tenant. Cleaning, rubbish, lawns
Tenants must leave the premises reasonably clean and tidy and remove all rubbish at the end of the tenancy.
Ms Maraki provided photographs showing the condition of the premises at the end of the tenancy. The premises were not reasonably clean and tidy. A small amount of rubbish was left behind at the end of the tenancy (mostly in the section), and the lawns were long.
The amounts claimed for cleaning, rubbish removal and lawn mowing are proven and are fair and reasonable. Damage
There was damage to the premises during the tenancy, specifically: a. Underfloor insulation damaged / pulled down. b. Damage to walls. c. Badly damaged door.
Ms Maraki provided a quote from Total Home Insulation which states that the “underfloor insulation has been extensively damaged by what appears to be dog(s)”. Ms Maraki confirmed that Ms Naera kept a dog at the property. The landlord’s photographs confirm Total Home Insulation’s statement. The damaged / pulled down insulation is not normal wear and tear. The insulation was installed in 2019.
I am satisfied that it is more likely than not that the insulation was damaged by Ms Naera’s dog. The cost of replacing the damaged insulation is proven.
The walls were damaged in several areas during the tenancy, and a door was badly damaged. The damage is shown in the landlord’s photographs. The cost of repairing the walls and replacing the door is proven. Water rates, rent
The previous order awarded water rates owed up to 2 October 2023. Water rates are owed from then to the end of the tenancy, based on the FNDC invoice in May 2024 and the final meter reading.
The claim is proven.
A rent payment from another tenancy was incorrectly credited to this tenancy. This was not picked up until after the end of the tenancy. The landlord seeks payment for this incorrectly credited rent, but it is not apparent that Ms Naera had any arrears even when this payment was reversed. Filing fee
The landlord has been successful in this application and I must award the landlord the filing fee of $27.00. Error in previous order
In the previous order I awarded the landlord $1,270.60.
The bond is $1,360.00.
The landlord should have received $1,270.60 from the bond, with the balance of $89.40 continuing to be held by the Bond Centre.
Due to an error, I made an order releasing all of the bond to the landlord and stating that the tenant was to pay the landlord $89.40.
I have corrected that error in the table above.
