Order

Jemma Lee Francombe (also known as Jemma Lee Everett) must pay Orbit Property Management Limited $482.35, calculated as shown in the table below.
The debt is to be paid at the rate of $10 per day starting today, 15 October 2024, and continuing every Tuesday thereafter until the debt is paid in full. If any payment is not made within two days of the due date, the sum then due will become payable immediately and this order may be enforced as an order of the District Court.
The Bond Centre is to pay the bond of $2,160.00 (3504788-009) to Orbit Property Management Limited immediately.
The landlord’s claim for storage costs is dismissed.
The claim for exemplary damages for interference with the smoke alarms is withdrawn.
The landlord may dispose of the tenant’s goods remaining at the premises as they see fit.

Reasons

Both parties attended the hearing.
The landlord has applied for compensation, payment of the bond and reimbursement of the filing fee following the end of the tenancy.
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.
The tenant did not return the keys.
The tenant also damaged the fire and burglar alarm systems in the premises.
The tenant accepted responsibility for the claims except for the claim for storage costs. This relates to goods left at the premises and stored in the garage. Whilst this may have been an inconvenience for the landlords, they have not incurred any expense arising from it and so the claim is dismissed.
The tenant confirmed that the landlord can dispose of the goods and so I have made a disposal order.
The landlord has largely succeeded and so I have awarded the filing fee.
