The tenancy ended on 11 March 2025. The landlord provided rent records and water rates invoices which prove the amounts owing for rent and for water rates at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (RTA).
The tenant did not leave the premises, including the lawns and gardens, reasonably clean and tidy and did not remove all rubbish.
The following chattels were missing at the end of the tenancy: an oven tray and a cutlery drawer insert. Both chattels were in new condition and the landlord had to replace them.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
The following damage was caused during the tenancy: •a wall power socket in the lounge was damaged and had to be repaired; •security lights fittings were damaged and had to be replaced; •the bedroom carpets were so badly stained and had paint marks that they had to be replaced; •walls throughout the premises were marked, damaged, and had substandard repairs. They had to be repaired, plastered, and painted.
The amounts ordered are proved by invoices, photos, and by the evidence the landlord gave at the hearing.
I have considered betterment and depreciation. The landlord should be returned to the position they would have been in had the tenant not breached their obligations and should not be better or worse off. The landlord applied depreciation of 50% to the claims for carpet replacement and the repair and painting of the walls. I have accepted that amount of depreciation as appropriate in this case.
As the application is successful, the tenant must pay the landlord’s Tribunal filing fee.
