The Bond Centre is to release the bond of $2,800.00 (Bond reference: 6201696-003) to Idea Home Property Management Limited upon receipt of the required forms and a copy of this Order, which must be submitted by Idea Home Property Management Limited.
Jenny Alofa Tauti is ordered to immediately pay Idea Home Property Management Limited a total amount of $6,397.54 for rent arrears to 19 may 2025, vacated damages/losses, and reimbursement of the filing fee, all of which are detailed in the table below:

Reasons

The landlord attended the hearing and was assisted by a Mandarin interpreter.
The tenant did not attend the hearing and did not respond to the Registry’s phone calls to her last known number. The landlord advised that the tenant had emailed the landlord directly on today’s hearing date stating she was out of Auckland and unable to attend in person but could attend via Zoom if necessary. However, the tenant did not directly contact the Tribunal, nor was any request to participate remotely ever received by the Registry.
The email used by the tenant matched the one used for service and in the tenancy agreement and was used by the Tribunal to notify her of the hearing. Given that the tenant was properly served, it was appropriate to proceed with the hearing in her absence, as permitted under section 92(1) of the Residential Tenancies Act 1986 (“the Act”).
The landlord applied for: a. Rent arrears; b. Compensation for damages; c. Refund of the bond; and d. Reimbursement of the filing fee.
The landlord no longer sought a termination order, as the landlord accepted that the tenancy effectively ended when the tenant abandoned the property around 19 May 2025. Rent and Water Arrears
The landlord provided rent records and water rates invoices, which supported the amounts claimed. These records were accepted, and amounts were ordered accordingly. Bond Refund
The Iandlord seeks, and it is appropriate, that I order refund of the bond to offset the amounts owed by the tenant to the landlord.
It is the landlord’s responsibility to lodge the appropriate paperwork and a copy of this Order with the Bond Centre for processing to receive the amounts sought and ordered. Tenant’s breach of obligations
The tenant failed to meet her obligations under section 40(1)(e)(ii)-(v) of the Act, which include: a. Leaving the premises reasonably clean and tidy; b. Removing all rubbish; c. Returning all keys and security devices; and d. Leaving all chattels provided for their benefit.
Additionally, under section 40(1)(ca), the tenant must replace worn out smoke alarm batteries and standard light bulbs.
The tenant provided evidence (including reports and invoices) to establish the following breaches of her obligations: a. The tenant did not leave the premises reasonably clean and tidy; b. The tenant did not remove all rubbish; c. The keys were not returned; d. Items noted in the order were missing and e. Light bulbs had to be replaced by the landlord. Damage to Premises
Under sections 40(2)(a), 41, and 49B of the Act, the landlord proved that damage occurred during the tenancy and was more than fair wear and tear. The tenant did not provide evidence to disprove liability. a. If damage is careless and covered by insurance, liability is limited to the insurance excess or four weeks’ rent, whichever is less (section 49B(3)(a)). b. If damage is not covered by insurance, liability is limited to four weeks’ rent (section 49B(3)(b)).
The damage identified exceeded fair wear and tear, occurred during the tenancy, and liability was established. The amounts ordered were supported by evidence. Filing fee
