The landlord applied for termination for abandonment, rent arrears, compensation, refund of the bond, and reimbursement of the filing fee.
The application concerns a fixed-term tenancy ending on 12 September 2025. Rent Arrears
The landlord discovered on 24 May 2025 that the tenant had returned the keys to a neighbour. The tenant did not inform the landlord that they were moving out.
The tenant is contractually liable for rent to the end of the fixed term tenancy or earlier re-letting. The landlord has been able to relet the premises from 30 June 2025. However, in a difficult rental market the new weekly rent is $520.00 - $60.00 less per week than the rental paid by the tenant.
I award rent at the weekly rate of $580.00 to 29 June 2025 (the date of re- letting) in the sum of $6,545.71.
The tenant is in breach of the fixed term, regardless of whether there has also been an abandonment. The loss of rent caused by the breach includes the difference between the old weekly rent and the new rent ($60.00 per week). Therefore, I also award $642.86 as compensation for the landlord’s loss of bargain. Cleaning and Rubbish
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. There was a trailer load of rubbish left behind. The premises needed cleaning throughout, including the carpets. Damage
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent. The insurance excess was $1,000.00.
Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for.
The wiring for the hot water cylinder was loose at the end of the tenancy. The hot water tap in the laundry had been removed. The shower head, hose, and mounting had been removed and left on the floor. A window was smashed, and the carpet was damaged at the join between the living area and the vinyl kitchen. There were several large holes in the walls.
The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage. Filing Fee
The landlord’s application has succeeded. I award the filing fee.
