Reasons

This Amended Order amends the Tribunal Order dated 29 January 2026. It is amended to include both bond numbers related to the tenancy.
The following is a repeat of the earlier Order.
This adjourned hearing was scheduled to be heard by video conference. Ms Saunders, who attended the last hearing on 20 November 2025, did not connect to the Teams link and her phone appears to have been disconnected. She has not advised the Tribunal of another number on which to ring her and so the hearing proceeded in her absence.
This Order ought to be read together with the Order dated 20 November 2025. The hearing on that day was adjourned for a number of reasons – the landlord had provided insufficient evidence to support their claim, Ms Saunders advised that she wished to make a counterclaim, and I was advised that Mr Richel had just received a very serious diagnosis. I was sorry to learn at today’s hearing that he has since passed away.
I note that prior to being made aware of Mr Richel’s passing I rang the phone number that had been provided for him in the application.
Ms Saunders has not made a counterclaim against the landlord and so today’s hearing addressed only the landlord’s claim. I left a voicemail saying that I would ring back in a few minutes, but my second call also went to voicemail.
The landlord has applied for rent arrears, compensation, payment of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

I accept the landlord’s evidence that the tenancy ended on 29 August 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy -$4,050.00. This includes the last payment of rent which was $500.00 on 8 August 2025.

Did the tenants comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The photographs show that the tenants did not leave the premises reasonably clean and tidy and did not remove all rubbish. There was a significant amount of rubbish and belongings left at the exterior of the house.
I accept the landlord’s evidence that one set of keys was not returned and so the locks needed to be replaced.
The amounts ordered to remedy these issues are proved with invoices .

Are the tenants responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
The evidence shows that during the tenancy a window and sliding door pane in bedroom 3 were broken. This s obviously more than fair wear and tear and the tenants are required to pay the cost of their repair.
The invoice shows that the cost of repair was $391.76. Filing fee reimbursement
The tenants are required to reimburse the filing fee to the landlord because the landlord was wholly successful with this claim against them. C ter Haar 9 April 2026
