Reasons
- Today’s hearing was scheduled as a video conference hearing. The landlord joined the hearing, however, when the tenant made no appearance, I attempted to contact them via phone and left a message on the number provided. I made a further attempt to contact them approximately five minutes later, but they remained unavailable. I noted that they had been properly served with the notice of hearing and given the opportunity to be heard but have not taken up this opportunity. I decided to conduct the hearing in their absence.
- This tenancy was terminated and rent arrears ordered by the Tribunal at a previous hearing. This application is for costs incurred by the landlord after the tenancy ended.
- At the end of a tenancy the tenant is responsible for returning the premises in a reasonably clean and tidy state, removing all their property, and returning the keys. The tenant is also responsible for any damage to the premises which has occurred intentionally or carelessly, with the proviso that for any damage which falls within coverage of the landlord’s insurance policy the tenant’s liability is limited to the insurance excess or four weeks rent (see S 40(1)(e), S 40 (2), and S 49B Residential Tenancies Act 1986). The tenant is not liable for wear and tear.
- In this case the landlord has provided photos showing that the carpets in the lounge and bedroom had marks and stains, which appeared to be more than fair wear and tear, and which were not present in the entry photos. I find that the landlords carpet cleaning costs are reasonable, and the tenant is liable for these.
- The landlord provided photos showing that the premises were left in and untidy and dirty condition the oven kitchen cupboards and laundry floor were all busily grubby and required cleaning. I find the landlords cleaning costs are reasonable, and the tenant is liable for these.
- The landlord has paid for the repair of two holes in walls. The first of these is a reasonably large hole in the wall of the lounge where it appears someone has punched or kicked the wall. The second hole, in bedroom one is a smaller round hole just above the skirting board, which appears to have been intentionally drilled in the wall using a hole saw. I conclude that this damage was intentional, and the cost to repair our lease than the insurance excess or four weeks rent. The landlord’s costs for repairing the walls are reasonable, and the tenant is liable.
- When the tenant left the premises, they did not return the keys. The landlord has paid to have the front door lock barrel replaced, and new keys provided. The costs are reasonable, and the tenant is liable.
- The tenant left a variety of rubbish in the tenancy including a mattress. The landlord’s costs for the rubbish removal are reasonable, and the tenant is liable.
- As the landlord has been successful in their application, I award the filing fee.
