- The applicant has provided water, rent, and electricity records showing the amounts owing. I am satisfied that these records are accurate. The rent arrears, water rates, and power charges are therefore awarded.
- The applicant states that on the day of eviction, the respondent was present and requested assistance to move her furniture. The applicant arranged a mover and now seeks reimbursement of $322.00. I am satisfied that the applicant’s account is more likely than not to be correct, and this amount is awarded.
- The applicant says that the respondent was in breach of section 40(1)(e)(iii) of the Residential Tenancies Act 1986, which requires tenants to leave the premises in a reasonably clean and tidy condition at the end of the tenancy. They seek $207.00 for carpet cleaning, stating that a cat had urinated in the property and there were strong odours.
- They also seek under this breach: $57.50 for lawns and garden work, $207.00 for flea treatment and $437.00 for general cleaning.
- I am satisfied that the respondent was in breach of section 40, and that these costs were reasonably incurred as a result of that breach. These amounts are therefore awarded.
- The applicant also states that the respondent failed to return the keys, in breach of section 40(1)(e)(iv), which requires tenants to return all keys at the conclusion of the tenancy. As a result, the applicant replaced the locks at a cost of $184.00. I am satisfied that this cost was reasonably incurred due to the respondent’s breach, and it is awarded.
- During the hearing, the applicant also sought recovery of a previous filing fee and bailiff costs associated with the eviction. These costs are properly recoverable under the previous order. It would be inappropriate to make additional orders where there is already an existing enforcement pathway available. Those claims are therefore dismissed.
- As the applicant has been successful in this application, the filing fee is awarded.
