- The tenancy property was a three bedroom house with a unit downstairs that was separately tenanted. There was one power meter for the whole property and a split meter to determine the usage of each tenancy.
- The landlord provided invoices for the last two months of the tenancy showing the usage of each property. The landlord provided invoices to the tenant for the amount of electricity in this tenancy for Aug/Sept 2025 ($345.56) and Sept/Oct 2025 ($324.73) together with a ledger showing that neither amount had been paid.
- These amounts are proved.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
- The landlord said that the tenant had not cleaned and had left a large amount of rubbish behind. The carpet had a strong odour and various stains, there were stickers on the walls and the glass in the back door was broken. The landlord produced an ingoing inspection report recording the condition of the property, photos from the end of the tenancy, and an email from the tenant acknowledging responsibility for the broken glass in the back door.
- The landlord produced invoices for the above items as follows: a. Cleaning - $293.25 b. Rubbish removal - $517.50 c. Removal of stickers - $77.63 d. Carpet cleaning and stain removal - $425.00 e. Window repair - $345.40
- I am satisfied that the tenant did not leave the property clean and tidy and did not removal all rubbish.
- I am also satisfied that there was damage (broken window and carpet stains) that occurred during the tenancy that is more than fair wear and tear.
- The amounts claimed are reasonable. These claims are proved. Filing fee
- Because Behome Realty Limited as agent for Hayden Harrison has wholly succeeded with the claim I must reimburse the filing fee.
