Ms Stewart arranged for flea treatment of the carpet, but even after two treatments the fleas were not eradicated.
The premises could not be re-tenanted with the carpet in that condition.
It was necessary to replace the carpet.
The proven cost of replacing the carpet was $3,905.00.
The evidence provided by the landlord shows that: a. The carpet was badly stained during this tenancy. b. The extent of staining, and the fact that the stains are faeces, justifies replacement of the carpet. c. The damage is substantially beyond ‘fair wear and tear’.
The claim for replacement of the carpet is proven. Because the carpet was less then two years old at the end of this tenancy, I will not apply any depreciation to the replacement cost claimed.
It was necessary and appropriate for Ms Stewart to arrange for pest treatment of the carpet. The cost of pest treatment is proven.
The tenant is liable for this cost. Replace lightbulbs, mowing
The claim originally sought $525.00 to “slash / knock down” the lawns and dispose of the clippings.
However, the invoice for this work is dated 29 February 2024, seven weeks after the end of the tenancy, and Ms Stewart’s photographs show that the lawns were tidy at the final inspection on 8 January.
