The Tribunal has previously made orders terminating this tenancy and awarding rent arrears, water rates, lawn mowing, change of locks, carpet cleaning, and exemplary damages (methamphetamine).

I adjourned the landlord’s claims for cleaning and repairs for the reasons set out in the previous order.

The third and final hearing took place today in Whangarei. Mr Gimranov represented the landlord. There was no appearance by the tenant.

Whangarei Lock and Joinery Services carried out the repairs per its 11 April quote, and issued a detailed invoice on 23 June 2025.

Mr Gimranov said that he reviewed the repair invoices and identified two repairs that are in the category of maintenance – removal of rot from the second bathroom and planing down the back door in the laundry so that it fits correctly. Removing the cost of this work from the invoice leaves a balance of $7,322.05 for repair of tenant damage.

Mr Gimranov provided a copy of the entry inspection report and final inspection report, with numerous photographs.

Tenants are liable for damage beyond fair wear and tear that occurs during the tenancy.

The evidence provided to me establishes that the following damage occurred during this tenancy and is beyond fair wear and tear: a. Damage to multiple internal doors. b. Damage to walls, including – pin holes (especially in the hallway), gouges and larger holes (some of which were partially repaired by the tenant). c. Office door badly damaged by being forced / kicked (replacement of door necessary). d. Adhesive film put on windows and fireplace without landlord’s knowledge or consent. e. French doors damaged, glass broken, security bolts broken. f. Architrave around entry door (into kitchen / dining) broken.

The cost of repair of this damage is proven. The repairs to the walls necessitated painting. The invoice states that ‘touch up’ painting was possible in some areas but the “rumpus room had to be painted entirely”. The invoice also notes “touch up skirting boards and scotia where needed) previous paint job had many over-runs)”.

Depreciation must apply to the painting of the rumpus room, and the tenant is not liable for the cost of touching up the previous poor paint job.

I will deduct $500.00 from the repair cost claimed to reflect this. Cleaning

The premises were not left in a reasonably clean and tidy condition.

Cleaning was not done until after the methamphetamine de-contamination. Mr Gimranov confirmed that the cleaning was carried out yesterday, 1 July 2025.

Mr Gimranov provided an invoice for $851.00 from Dirt Be Gone Ltd. The invoice is comprised of $600.00 plus GST for cleaning and $140.00 plus GST for replacement of lightshades and shower curtains.

The condition of the premises as at 1 July 2025 is not necessarily the same as the condition at the end of this tenancy nearly three months ago. Mr Gimranov’s final inspection photographs show the condition at that time.

Having regard to those photographs, and acknowledging that depreciation must apply to the claim for replacement of chattels, I will award 75% of Dirt Be Gone’s invoice. Fleas

There was a flea infestation at the premises.

The landlord has been largely successful in this application and I will also award the landlord the filing fee of $27.00.

The bond was released to the landlord on 6 May 2025.
